TERMS AND CONDITIONS

These Terms and Conditions (the “Terms”) govern the contractual relationship between you (the “Client”) and Pure Essence Travel (the “Company”) concerning any travel products or services provided by Pure Essence Travel (the "Trip"). Please read all of the terms and conditions detailed below carefully before booking your experience with Pure Essence Travel.

By booking any product(s) or service(s) with Pure Essence Travel, or by participating in a trip organized by Pure Essence Travel, you acknowledge and agree to the following:

  1. You have read and understood these Terms, and

  2. You express your acceptance and agreement to be bound by these Terms.

Application to Group and Private Trips If you confirm a booking for more than one traveler on a trip, you are agreeing to these Terms on behalf of all participants (including minors and individuals with disabilities). The person confirming the booking will be considered the primary contact for all other individuals listed on the booking.

These Terms constitute the entire agreement between you and Pure Essence Travel with respect to the subject matter and supersede all prior understandings or agreements. Please note that this Terms and Conditions document applies only to experiences fully organized by Pure Essence Travel and not in conjunction with any third-party operators.

THE BOOKING CONTRACT

A booking is confirmed when Pure Essence Travel, or an authorized agent acting on the Company’s behalf, has received the required deposit from you and provided written confirmation. The Client confirming the booking must be at least 18 years of age and agrees to provide accurate and complete information for the booking. If the booking includes multiple clients, you, the primary booker, warrant that:

  • You have the necessary consent and authority to book on behalf of all others listed in the reservation.

  • The information provided for all clients is accurate and complete, and you have obtained consent to share this information with Pure Essence Travel.

  • You will notify all parties on the booking about the applicability of these Terms to the experience.

Modification of Pricing & Booking Rights Pure Essence Travel reserves the right to adjust pricing for products and services at any time before confirmation. Additionally, the Company reserves the right to refuse any booking at its discretion.

CONFIRMATION AND ITINERARY SUBJECT TO MODIFICATION

Once your deposit is received, you will receive a confirmation email. If you do not receive this email within five (5) business days, please contact us. After booking, you may receive correspondence related to the trip, including your itinerary. The itinerary is subject to change, and Pure Essence Travel reserves the right to modify it at any time due to availability of third-party vendors, weather, local conditions, or any other unforeseen circumstances.

PAYMENTS

a) Total Payment: Full payment is due prior to the trip’s start date (the “Payment Due Date”). The Payment Due Date will be communicated to you upon booking. Failure to pay by the due date may result in the cancellation of your booking, with forfeiture of your deposit and any amounts already paid. The full payment is non-refundable and non-transferable.

b) Deposit: All deposits and payments are non-refundable. However, in case of cancellation, your payments are protected and can be used as credit or transferred to a future trip of your choice. Your deposit is non-refundable and non-transferable. You may request that your deposit be applied to another participant's booking before the Payment Due Date, though you are responsible for finding a replacement participant.

c) Payments After Deposit: Cancellations made 30-60 days before the trip are subject to a 50% cancellation fee of the total paid amount after the deposit. The remaining balance will be applied as a credit towards a future trip. Cancellations made within 30 days of departure are subject to a 100% cancellation fee.

d) Late Payment: Failure to make a payment within 10 days of the agreed date is a breach of contract and may result in the cancellation of your booking. If you anticipate a late payment, please notify us immediately via email at Tenisha@pureessencetravel.com. A $30 late fee may apply, and Pure Essence Travel reserves the right to assign your spot to another client.

CANCELLATION BY THE CLIENT

Cancellations must be made in writing and acknowledged by Pure Essence Travel. All cancellations are non-refundable and non-transferable. We strongly recommend purchasing travel insurance to protect your investment. Trip cancellation insurance is the only means to receive reimbursement for non-refundable expenses such as flights.

  • Amendments and Cancellations: You may cancel or amend your trip up to 60 days before departure. Any cost differences between the original and new booking will apply. Cancellations within 60 days of departure will follow the cancellation policy outlined below.

  • Credit Balances: Any applicable credit resulting from a cancellation will be valid for one year from the cancellation date.

  • Installment Transfer Option: You may transfer your installment payments to another participant prior to the Payment Due Date, but it will be your responsibility to find the replacement. A transfer administration fee will apply.

REFUNDS

Refunds will only be issued in the event of a complete trip cancellation by Pure Essence Travel. In all other cases, payments made toward your trip (including late fees and installments) are non-refundable. We strongly recommend purchasing travel insurance to cover unforeseen cancellations or losses.

  • Unused Services: Pure Essence Travel will not offer or pay any discounts or refunds for missed or unused services that result from the client’s fault or negligence, including termination of participation due to the client's breach of these Terms.

WHY IS MY PAYMENT NON-REFUNDABLE?

Payments are non-refundable because our vendor partners (such as hotels and excursion providers) require upfront commitments. These commitments are necessary to confirm your participation in the trip, and we must fulfill these financial obligations to secure your booking.

PASSPORT, VISA, AND RELATED ITEMS
You are responsible for obtaining and maintaining a valid passport and all necessary visas, permits, certificates, or other required documents for the countries or areas you will visit. The Company is not liable if you are denied entry or exit due to missing documentation.

You are responsible for obtaining your own travel insurance to cover the entire trip. It is required that you purchase insurance when booking your spot to cover any unforeseen circumstances that prevent you from attending or during your trip. You are also responsible for the cost of insurance and making sure it covers you for illness, injury, loss of baggage, cancellations, and any other potential risks or damages. The Company is not liable for any losses resulting from your failure to obtain insurance.

CHANGES OR CANCELLATIONS

  • Trip Changes: The Company may change any aspects of the trip (activities, schedule, accommodation, etc.) if deemed necessary due to adverse conditions or other circumstances beyond control. You will not be eligible for refunds based on such changes.

  • Trip Details: The itinerary is a guide and may change based on local factors or weather conditions. You acknowledge and assume responsibility for any inherent risks in the activities.

  • Flexibility: By booking a trip, you acknowledge that flexibility is necessary. Changes to the route, schedule, and itinerary may happen due to unforeseen events like weather, strikes, or medical emergencies.

  • Cancellations by Company: If your full payment isn't received on time or if the trip doesn't meet the required number of participants, the Company reserves the right to cancel the trip and offer a full refund, but is not liable for other costs like airfare or travel documents.

  • Cancellations by You: Cancellations must be made in writing. If canceled before the payment due date, you will get a refund minus the non-refundable deposit. After the due date, you will lose the entire amount paid.

HEALTH & FITNESS ELIGIBILITY, STRENUOUS ACTIVITY, AND INJURY

  • Voluntary Participation in Physical Activity: You acknowledge that the trips may involve strenuous activities (e.g., hiking, swimming, yoga) and accept the risks associated with them. You are responsible for obtaining appropriate travel insurance for these activities.

  • Health and Fitness: You confirm that you are in good physical and mental health and are able to participate in the trip. If needed, consult your doctor before booking and seek medical clearance if necessary.

  • Assumption of Risk: You understand that serious accidents can happen during physical activities and accept full responsibility for these risks, including injury or death. The trip may take place in remote areas with limited medical access, and you are responsible for any medical costs or evacuation.

  • Injury: If you are injured during the trip, you assume all financial responsibility for medical expenses. The Company is not liable for any injuries or losses you incur.

WAIVER OF LIABILITY AND RELEASE
By participating in the trip, you release the Company and its representatives from any liability for injuries, losses, or damages, including medical expenses, pain, illness, death, or property damage. Whether or not you purchase insurance, you will not seek reimbursement from the Company for any liabilities.

INDEMNITY & BINDING EFFECT

  • Indemnity: You agree to indemnify and hold the Company harmless for any issues arising from your participation in the trip, including any special requests, allergies, or dietary requirements. While the Company will try to accommodate requests, it is not guaranteed. You will also be responsible for verifying any special requests during booking.

  • Binding Effect: This agreement is binding on you, your family members, and heirs, and applies even after your death.

VALIDITY
The prices of services or products displayed on the Pure Essence Travel website are based on the costs effective at the time of posting. Pure Essence Travel reserves the right to adjust the prices of any products or services at any time prior to receiving full payment. All dates, itineraries, and prices listed are for guidance purposes only. The price quoted at the time of booking will be the applicable price, subject to any surcharges as detailed above. Pure Essence Travel may make changes, updates, or revisions to any details on the website before a contract is finalized, and such changes will take effect from the date of their publication.

CLIENT RESPONSIBILITY
The Client acknowledges that depending on the nature of the services or products booked, and the specific locations where they will operate, travel may involve certain inherent risks. Adventure travel, by nature, can present risks to health and safety, and by confirming the booking, the Client assumes these risks. The Client has carefully considered their personal capabilities and the potential challenges involved in the journey. Pure Essence Travel encourages all clients to take personal responsibility for their own safety and well-being and reminds travelers to consult with local authorities or embassies about specific safety concerns before embarking on the journey. Pure Essence Travel is not responsible for providing specific guidance regarding local customs, laws, weather conditions, or physical challenges in the locations where services or products are provided.

SEVERABILITY
If any term or condition of this agreement is found to be unenforceable or void by law, public policy, or any other reason, such provision will be severed or amended to the extent necessary to allow the remainder of the agreement to continue in effect. The invalidity of any provision will not affect the enforceability of the remaining provisions.

IMAGES AND MARKETING
The Client agrees that during participation in any trips or services offered by Pure Essence Travel, photographs, videos, or other media may be taken by fellow clients or our team members. The Client consents to the use of these media in which they may appear. By participating, the Client grants Pure Essence Travel a perpetual, royalty-free, worldwide, and irrevocable license to use, reproduce, display, and distribute such media for marketing, promotional, or any other purpose without further compensation or obligation to the Client.

GROUP PHOTOS
We prioritize privacy and data protection for all travelers and guests. While on trips, our Trip Managers may organize group photo opportunities, which may be shared on Pure Essence Travel's social media platforms, including Facebook, Instagram, Twitter, and LinkedIn. These images will only be used for company promotion. If the Client prefers not to be included in these group photos, they are welcome to excuse themselves from the photo sessions organized by the Trip Manager.

OTHER CONDITIONS
Each guest must adhere to the terms, conditions, requirements, laws, rules, and/or regulations of any service provider, country, or governmental authority and will be held responsible for any failure to comply with such regulations. Pure Essence Travel retains the right to refuse service to any client at any time, for any lawful reason, in its sole discretion.

GENERAL
Entire Agreement: This Agreement constitutes the entire understanding between you and Pure Essence Travel and supersedes any prior agreements or representations regarding the subject matter hereof. You acknowledge that no oral representations, statements, or inducements, apart from those expressly set forth in this Agreement, have been made to you by any representative of Pure Essence Travel.

Force Majeure: If Pure Essence Travel is prevented from fulfilling any of its obligations due to circumstances beyond its control, including but not limited to acts of God, strikes, trade disputes, inclement weather, transportation disruptions, governmental or political actions, acts of war or terrorism, or acts/omissions of third parties, Pure Essence Travel shall have no liability. In such cases, the company may, at its sole discretion, either cancel the trip or take reasonable actions to mitigate the impact on the Client. Clients will not be entitled to a refund for amounts paid, and Pure Essence Travel will not be responsible for additional costs incurred, including travel arrangements, documents, or other incidental expenses.

Choice of Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of New York. The parties agree to submit to the exclusive jurisdiction of the courts located in New York for any disputes arising out of or related to this Agreement.

Interpretation: You acknowledge and agree that this Agreement, including the releases and waivers of liability herein, is intended to be as broad and inclusive as permitted by applicable law. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the provisions shall continue to be binding and enforceable.

Waiver: The failure or delay by Pure Essence Travel in enforcing or exercising any provisions of this Agreement shall not constitute or be deemed a waiver of such provision or any other provision hereof. A waiver of a breach of any provision of this Agreement shall not be construed as a waiver of any other breach or of the provision itself.

By booking a group trip experience with Pure Essence Travel, you acknowledge and understand that trip details are subject to change. While efforts are made to provide an accurate representation, changes may be necessary based on factors such as weather, local conditions, traveler feedback, and new opportunities.
